The Chamber of Cosmetics Industry of the Philippines (CCIP), along with 18 of its member companies, signed last week the E-Commerce Memorandum of Understanding (MOU)—facilitated by the Intellectual Property Office of the Philippines (IPOPHL)—to fight back more intensively against the increased sale and advertisement of counterfeit cosmetic products online.
The move builds on the CCIP’s partnership with IPOPHL in 2023 which allowed for closer coordination in combating IP violations and enabled IPOPHL to train CCIP members to integrate IP protection and enforcement into their business strategies. With its signing of the landmark E-Commerce MOU, the CCIP is looking to ramp up IP enforcement efforts.
IPOPHL Director General Brigitte M. da Costa-Villaluz lauded the CCIP’s proactive approach to protecting IPs and brand reputation of its member companies while ensuring the general public’s enjoyment of cosmetics without the threat of fake products.
“Through this MOU, the CCIP and its members will now be part of the collective drive of protecting both the cosmetics industry and the health and safety of the public. This collaboration is a protective measure so that cosmetics products, from skincare to makeup, can be availed of by people around the world not only for their high quality but also for their authenticity,” said da Costa-Villaluz who was present as the main witness to the signing.
The MOU brings together online platforms, brand owners, industry associations and chambers of commerce. It aims to establish a code of practice for online business, enhance collaboration among signatories and implement an efficient notice and takedown procedure.
IPOPHL Deputy Director General Nathaniel S. Arevalo emphasized the benefits CCIP will realize as a signatory.
“Originally conceived as a stopgap measure, the MOU has proven to be an effective tool that gives us the fighting chance to race against IP violators who flood platforms with fake cosmetic products. The MOU complements the goals of the Internet Transactions Act (ITA) and has been recognized as a best practice within the ASEAN region,” Arevalo added.
As the cosmetics industry continues to grow, CCIP President and Amway President Christine Michelle P. Reyes said the industry becomes “increasingly susceptible” to online counterfeiting.
“As the rise of e-commerce platforms has led to a rapid spread of counterfeit goods online, brands have difficulty in protecting their intellectual property due to damaged brand reputation, escalated risks to consumer safety from the sale of unsafe or substandard products. Signing this E-Commerce MOU is a pivotal move for CCIP towards promoting a more collaborative strategy for tackling counterfeit cosmetic products in online marketplaces. We are grateful to IPOPHL for this partnership, as we believe it will enable both emerging and established cosmetic brands to succeed,” Reyes added.
CCIP Executive Vice-President for External Affairs and HairReve CEO and Founder Janina Gutierrez-Tan called the MOU a “game-changer.”
“With IPOPHL, the e-commerce platforms and the cosmetic industry working together, we are a big step closer towards winning against piracy and against counterfeit products. CCIP is extremely grateful to IPO for this initiative,” said Gutierrez-Tan.
In addition to the CCIP, member companies signed the MOU, namely JRadiance Corp., GT Cosmetics Manufacturing Inc., Kimiki Solutions, Inc., Chemworld Marketing Corp., Rainiers Research & Development Institute, Inc., Vivanti Executive Advantage, Inc., Z Lab International Corp., Snoe Beaute Produits, Inc., Scentful Lifestyle Concepts OPC, Green Cross, Inc., Amway Philippines LLC, Chromaesthetics, Inc., UL Skin Sciences, Inc., Personal Collection Direct Selling, Inc., Ever Bilena Cosmetics Inc., Ivy Andrea Beauty Corp., Prime Global Corp., and Elegant Fumes Beauty Products, Inc.
With the foregoing, the total signatories to the E-Commerce MOU now stands at 65.
Established in 1974, the CCIP is a non-profit organization with about 200 members, composed of manufacturers, distributors and brand owners. It is committed to elevating the cosmetics industry by promoting regulatory compliance, local and global linkages, innovation, education and advocacy.
